This Privacy Policy describes how we collect, use, maintain, protect, and disclose personal information when you use the Services.
This Privacy Policy, together with any documents it expressly incorporates by reference, including our Terms of Use and Cookie Policy, applies to personal information we collect:
Through the CrowdNoise website.
In email, text, push notifications, and other electronic communications between you and CrowdNoise.
Through the CrowdNoise mobile applications distributed through app stores.
When you interact with CrowdNoise content, advertising, or applications on third-party websites and services.
This Privacy Policy does not apply to information collected by:
CrowdNoise offline or through a channel that provides a different privacy notice; or
any third party, including through an application, website, sports-data feed, payment service, or content that may link to or be accessible from the Services, except as this Privacy Policy expressly describes.
CrowdNoise Foundation. CrowdNoise Foundation is a separate organization. If the Foundation collects information directly in connection with an award application or award administration, it may provide a separate privacy notice at the time of collection.
Please read this Privacy Policy carefully to understand how CrowdNoise handles your information. If you do not agree with these practices, do not use the Services. By accessing or using the Services, you acknowledge this Privacy Policy. This policy may change from time to time (see Changes to Our Privacy Policy). Please check it periodically for updates.
2. Children Under the Age of Thirteen (13)
The Services are intended for users who are at least thirteen (13) years old. We do not knowingly collect personal information from children under thirteen (13). If you are under thirteen (13), do not create an account, use the Services' profile, game, messaging, or other interactive features, or provide personal information to us. If we learn that we collected personal information from a child under thirteen (13), we will delete it. If you believe we may have information from or about a child under thirteen (13), contact us at admin@crowdnoise.com.
Users Under the Age of Eighteen (18). If you are a registered user under eighteen (18) years of age and a California resident, you may request that we remove content or information you posted that is accessible to another user. To make a request, use the methods described in Section 11 or email admin@crowdnoise.com with the subject line "Minor Content Removal Request." Removal does not ensure complete or comprehensive removal from our systems, and we may retain information where permitted or required by law.
3. Information We Collect About You and How We Collect It
We collect several types of information from and about users of the Services, including:
account and profile information, such as your name, username, email address, telephone number if you provide it, profile image or avatar, and other identifiers associated with your CrowdNoise account;
sports and fanbase activity information generated through available features, such as favorite teams, fanbases you follow or join, sports and game preferences, game selections and results, interactions with athlete profiles, traits or messages you submit, and users or private groups with whom you interact;
device, network, and usage information, such as IP address, device and operating-system information, app version, browser type, pages or screens viewed, and interactions with the Services; and
subscription and transaction information, such as subscription status, entitlements, and app-store transaction records (app-store payments are processed by the app stores; we do not receive full payment-card numbers).
We may also collect diagnostic and crash data, including exception traces and a short history of in-app actions preceding an error; route and navigation history within the app; and feedback content, including messages, files, or screenshots that you voluntarily submit through the in-app feedback tool. See Section 9 for service providers that process this data on our behalf.
We collect this information:
Directly from you when you create or update an account, use a feature, submit content, or contact us.
Automatically when you use the website or mobile applications. Automatically collected information may include usage details, IP addresses, cookies, local storage, mobile identifiers, SDK data, and similar technologies.
From service providers, app stores, sports-data providers, and other business partners.
4. Information You Provide to Us
Information you provide through the Services may include:
Information you provide when creating or updating an account or profile; selecting teams or fanbases; playing games or participating in challenges; joining or using private groups; interacting with athlete profiles; entering a sponsor promotion made available through the Services; or reporting a problem.
Records and copies of your correspondence (including email addresses), if you contact us.
Your responses to surveys that we might ask you to complete for research purposes.
Searches you make within the Services, such as searches for teams, fanbases, athletes, or sports content.
You may also provide profile information, messages, comments, photos, game responses, or other content through profiles, fanbases, athlete profiles, games, private groups, chat, or other interactive features (collectively, "User Content"). Depending on the feature and audience, User Content may be visible to members of a private group, other CrowdNoise users, or the public. Share only content you are comfortable making available to the applicable audience. Other users may copy or share content outside the audience you intended, and no security measure is perfect.
5. Information We Collect Through Automatic Data Collection Technologies
When you use the Services, we may use automatic data-collection technologies to collect information about your device, network connection, browsing activity, and in-app activity, including:
Details about how you use the Services, such as pages or screens viewed, features accessed, interactions with fanbases, athlete profiles, games, and private groups, logs, referring URLs, and performance or diagnostic data.
Information about your device and network connection, including IP address, device type, operating system, app version, and browser type.
We may use cookies, SDKs, pixels, and similar technologies for functionality, security, diagnostics, analytics, and, where applicable, advertising. Depending on their configuration, these technologies may collect information over time or across third-party websites or online services. For information about available tracking choices and how we respond to web browser "Do Not Track" signals and other opt-out preference signals (such as Global Privacy Control), see our DNT Disclosure at https://crowdnoise.com/legal/dnt and Section 10 of this Privacy Policy.
Automatically collected information may include personal information, or we may associate it with personal information collected in other ways. We use it to operate, secure, measure, and improve the Services and to provide a more relevant sports-fan experience, including by enabling us to:
Measure audience size, feature use, game participation, and performance.
Remember account settings, team and fanbase selections, and other preferences.
Support navigation, search, and delivery of relevant sports content and games.
Maintain sessions and recognize you when you return to the Services.
The technologies we use for this automatic data collection may include:
Cookies (or browser cookies). A cookie is a small file stored by your browser. You can configure your browser to refuse some or all cookies or alert you when cookies are sent. If you refuse cookies, some website features may not function properly.
Local Storage and Mobile SDKs. The Services may use browser local storage, mobile device identifiers, and software development kits ("SDKs") to provide app functionality, maintain sessions and settings, measure performance, and diagnose errors.
Web Beacons. The website and our emails may contain small electronic files, sometimes called web beacons, pixels, or tags, that help measure page visits, email opens, content usage, and system performance.
Some automatically collected information, such as IP addresses and other online identifiers, may be personal information under applicable law. We may associate this information with account or profile information.
6. Third-Party Use of Cookies and Other Tracking Technologies
Some analytics, sports content, sponsor experiences, advertisements, or other functionality in the Services may be provided by third parties. Depending on the technology used, these providers may use cookies, SDKs, pixels, or similar technologies to collect information when you use the Services. The information may include personal information and may be used for analytics, content delivery, advertising, or other purposes described by the provider and CrowdNoise.
We do not control how an independent third party uses information it collects under its own privacy policy. For information about available tracking and advertising choices, see Section 10.
7. How We Use Your Information
We may use information that we collect about you or that you provide to us, including personal information:
To operate and present the Services, including accounts and profiles.
To provide the sports content, fanbase experiences, games, private groups, athlete profiles, and other features you request or use.
To personalize the Services based on teams, fanbases, games, and sports content that interest you.
To carry out our obligations and enforce our rights arising from contracts, subscriptions, promotions, and other agreements.
To notify you about changes to the Services, your account, or features and programs available through CrowdNoise.
To enable sports games, fanbase participation, private-group interaction, messages, recommendations, promotions, and other interactive features.
To provide support, diagnose errors, maintain safety and security, prevent fraud or abuse, and improve the Services.
For any other purpose with your consent.
We may also use your information to contact you about CrowdNoise updates, sports content, games, and sponsor offers or promotions that may interest you. See Section 10 for available communication choices.
We may use information to display and measure sponsor content, advertisements, or promotions through the Services. Any disclosure of personal information to a sponsor or advertiser must be described in this Privacy Policy or at the time of collection and must comply with applicable law.
8. Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.
We may disclose personal information as described in this Privacy Policy:
To our subsidiaries and affiliates.
To contractors, service providers, and other third parties we use to support our business.
To a buyer or other successor in connection with a merger, divestiture, restructuring, reorganization, dissolution, bankruptcy, or other sale or transfer of some or all of CrowdNoise, LLC's assets, where personal information about users of the Services is among the transferred assets.
To sponsors or other third parties when needed to provide a sports promotion, offer, game, or experience you choose to use, or when you consent to the disclosure.
To fulfill the purpose for which you provide the information. For example, User Content or private-group activity may be disclosed to the users or audience associated with the feature you choose to use.
For any other purpose disclosed by us when you provide the information.
With your consent.
We may also disclose your personal information:
To comply with any court order, law, or legal process, including responding to any government or regulatory request.
To enforce or apply our terms of use and other agreements.
If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of CrowdNoise, LLC, our customers, or others.
We disclose certain data to service providers that support app and website operations, such as crash monitoring and user feedback. Section 9 describes identified providers and the data they process.
9. Service Providers and Third-Party Vendors
CrowdNoise uses service providers to operate, secure, support, and improve the Services. Service-provider categories may include cloud hosting and authentication, sports-data feeds, messaging, app distribution and payments, analytics and attribution, support, and crash reporting. Our service providers process personal information under contracts that restrict processing to providing services to CrowdNoise and impose applicable confidentiality, security, and data-protection obligations. We do not disclose personal information to the providers identified below for their own cross-context behavioral advertising or direct marketing.
Sentry — Crash and error monitoring. When the CrowdNoise mobile app encounters an error or crash, diagnostic information is transmitted to Sentry to help us identify and fix issues. This information includes: JavaScript exceptions and native crash traces, stack frames, a short history of user actions preceding the error ("breadcrumbs"), the current app route, the device model and operating system version, and — for signed-in users — the user's internal CrowdNoise ID, email address, and username. Sensitive request headers (including authorization tokens) and payment-related secrets are stripped from this data on the device before transmission. See Sentry's Data Processing Agreement (https://sentry.io/legal/dpa/), sub-processor list (https://sentry.io/legal/sub-processors/), and privacy policy (https://sentry.io/privacy/).
Gleap — In-app user feedback. When a user voluntarily submits a bug report, feature request, or support conversation through the in-app feedback tool, the submission is transmitted to Gleap. This includes: the feedback text and any subsequent conversation messages, any files or screenshots the user chooses to attach, network log metadata (with sensitive headers redacted), recent console output, the current app route, the device model and operating system version, and — for signed-in users — the user's internal CrowdNoise ID, email address, name, and phone number (when present). Automatic screenshots are disabled; only attachments the user explicitly chooses to upload are included. See Gleap's Data Processing Agreement (https://gleap.io/dpa) and privacy policy (https://gleap.io/privacy-policy).
10. Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:
Tracking Technologies and Advertising. You can configure your browser to refuse some or all cookies or alert you when cookies are sent. Mobile operating systems may also provide controls for advertising identifiers, tracking permissions, and app permissions. If you disable a technology, some Services features may not function properly. For information about how we respond to browser "Do Not Track" signals and other opt-out preference signals (including Global Privacy Control), see our DNT Disclosure at https://crowdnoise.com/legal/dnt.
Disclosure for Third-Party Advertising. If applicable law gives you a right to opt out of disclosure, sale, or sharing of personal information for targeted advertising, submit the request using the methods in Section 11 or email admin@crowdnoise.com.
Promotional Communications. You may opt out of promotional emails by using the unsubscribe link in an email or by emailing admin@crowdnoise.com. We may still send non-promotional communications about your account, security, or requested transactions.
Targeted Advertising. Where applicable, you may request to opt out of targeted advertising by using the methods in Section 11 or emailing admin@crowdnoise.com. Available browser, device, app-store, or third-party controls may also affect advertising and tracking.
Push Notifications. You can opt out of push notifications from the CrowdNoise mobile applications by changing notification settings on your device.
11. Accessing, Correcting, and Deleting Your Information
You can review and change available profile information in the CrowdNoise mobile app by opening the user menu in the upper-left corner and selecting "Edit Profile."
Account and Data Deletion. You may request deletion of the personal information we hold about you, including your account, at any time. You can delete your account directly in the CrowdNoise app, or you can submit a request by emailing admin@crowdnoise.com from the email address associated with your account with the subject line "Data Deletion Request." For step-by-step instructions for both methods, see our Account and Data Deletion Instructions at https://crowdnoise.com/legal/data-deletion.
What happens when you request deletion. We may take reasonable steps to verify that a request is authorized. We will respond without undue delay and generally within forty-five (45) days after receiving your request, subject to identity verification and any extension permitted by applicable law; if additional time is permitted and needed, we will notify you within the initial response period. Deleting your account is permanent. Deleting your CrowdNoise account may not cancel an auto-renewable subscription billed through an app store; to prevent future charges, cancel the subscription through the applicable app-store settings.
Exceptions. We may retain information where permitted or required by law, including information needed for security, fraud prevention, legal compliance, dispute resolution, enforcement, or transaction records. Residual copies may remain in routine backups for a limited period before being overwritten.
Service Providers. Where required in connection with a deletion request, we instruct applicable service providers that process personal information on our behalf to delete or return it, subject to permitted retention.
Retention. We retain personal information only as long as reasonably necessary for the purposes described in this Privacy Policy, including maintaining an account, providing requested Services, complying with legal obligations, preventing abuse, and resolving disputes.
12. Your U.S. State Privacy Rights
Depending on where you live, applicable state law may give you rights to access, correct, delete, or obtain a copy of personal information and to opt out of certain targeted advertising, sale, sharing, or profiling. You may also have the right not to receive discriminatory treatment for exercising a right.
To exercise an applicable right, use the methods in Section 11 or email admin@crowdnoise.com. We will respond to requests to access, correct, delete, or obtain a copy of personal information without undue delay and generally within forty-five (45) days after receipt, subject to applicable verification and any extension permitted by law. We process requests to opt out of the sale or sharing of personal information, targeted advertising, or profiling within the shorter period, if any, required by applicable law, and we do not require identity verification for an opt-out request except as reasonably necessary to identify the information or device associated with the request. Where required by applicable law, we treat legally recognized universal opt-out preference signals (such as Global Privacy Control) as a valid request to opt out of the sale or sharing of personal information. Where permitted, an authorized agent may submit a request on your behalf.
Appeals. If applicable law provides an appeal right, you may appeal by replying to our response with the subject line "Privacy Appeal." If we deny the appeal, our response will explain how to submit a complaint to the appropriate regulator, as required by applicable law; for example, Texas residents may submit a complaint to the Texas Attorney General.
California Civil Code § 1798.83 permits California residents to request certain information about our disclosure of personal information to third parties for their direct-marketing purposes. To make a request, email admin@crowdnoise.com.
13. Data Security
We use administrative, technical, and organizational safeguards designed to protect personal information against accidental loss and unauthorized access, use, alteration, or disclosure. Information may be stored or processed by CrowdNoise and its service providers. We use encryption in transit where appropriate.
Before diagnostic or feedback data is transmitted to our third-party processors, the CrowdNoise mobile app strips sensitive request headers (including authorization tokens and session credentials) and payment-related secrets from the outgoing payload to reduce the risk of accidental disclosure.
You are responsible for protecting your account credentials and for promptly notifying us of suspected unauthorized access. Do not share passwords or authentication codes. Use care when sharing information in profiles, game interactions, messages, private groups, or other features visible to other users, because recipients may copy or redistribute it.
No internet transmission or storage system is completely secure. Although we use safeguards designed to protect personal information, we cannot guarantee absolute security.
14. Changes to Our Privacy Policy
We will post changes to this Privacy Policy on this page and update the revision date at the top of the policy. Where required by applicable law, we will provide additional notice of material changes, which may include notice through the Services or email to the address associated with your account. Please keep your account contact information current and review this policy periodically.
15. Contact Information
To ask questions or comment about this Privacy Policy and our privacy practices, contact us at: admin@crowdnoise.com.
